Legal Question in Civil Litigation in Florida

Re: A slip and fall accident, our attorney has been holding a good portion of the settlement money to cover any

possible medical expenses not paid but its been over 7 years since the accident and the only outstanding bill i that Medicare is

asking we pay them a certain amount to cover what they paid. We have instructed our attorney to pay this amount but he refuses

to do so. How can we either get him to pay the mount or return us the money he is holding now? And, Is there a way we can dismiss

the attorney and not have to hire another attorney to get the funds he is holding?

You can write attorney and direct him to pay the sums due to Medicare and disburse the balance to you since all bills are not longer enforceable. If that does not work, you can file a complaint with the Florida Bar for his withholding the money without explanation. You can also hire an attorney to pursue the funds in trust as well.
