Legal Question in Civil Litigation in Florida

Small Claims Civil suit

What is the statute of limitations for a small claims suit of $500 in Hillsborough County, Florida? I prepared the suit and paid the process-server fees (twice because the sheriff's office said they couldn't find the office address). What is the time deadline for the process server?

Thank you.

Re: Small Claims Civil suit

There is no statute of limitations for small claims. The statue of limitations applies to the type of lawsuit you are filing. For instance, if you are suing someone for breach of contract, the statute of limitations is normally five years. It's irrelevant whether the lawsuit is in small claims court or some higher-level civil court.

The deadline for the process server is 120 days, but they rarely take that long.
