Small claims court is for cases in which the amount in dispute is $5000 or less. There is no rule that says agencies cannot be sued in small claims court just because they are agencies. However, there may be a multitude of other reasons why the particular claim you are trying to make is not properly brought against the agency in court. These reasons include, but are not limited to, the agency being immune from the type of claim you are making, or that you must exhaust administrative remedies before you can proceed against the agency in court.
