Small Claims-Stolen Property

I own a small boat that I brought to an shop to have the

boat top repaired. I had the boat in the shop

approximately four times for repair and for work not

done as agreed. The last visit the boat motor was

stolen from the gated yard and the lock was cut on the

boat. Estimated loss $3,500. The owner of the shop

states he is not responsible for customer's property

while left for repair. He further states there is a sign that

states this policy. I was never told this at any time nor

have I seen the sign. The work orders are void of any

disclosurer. I hold them totally responsible for my loss.

Had I been notified in the beginning I could of optained

insurance. What are my options?

The sign will help reduce the boat shop's liability but may not completely relieve him of liability. If the boat shop was negligent in any manner in allowing the theft to occur then they may have liability. The boat shop's insurance may also cover such theft. Please seek local counsel in your area to fully advise you.
