Legal Question in Civil Litigation in Florida
I get a social security check for my son, his father passed away. My family took it upon themselves to contact the social security office and change this to where the check is now recieved by my parents. They are refuseing to give me any of this money, and I cannot afford to house/clothe/feed my son without this. Do I have any legal recourse to getting this money back?

Yes. If you have custody of your son, how did your parents have the authority to change your account information? Who are the checks made out to? If this check is made out to you, as sole caregiver for your son, then your parents must be forging your name on the checks in order to cash them. This is a criminal offense. Contact the social security office, and get copies of the cashed checks. Contact an attorney to protect your son's rights. If you discover that your parents have been signing your name to your checks, contact the local prosecuting attorney to press charges.
