My son's 16 yr. old girlfriend crashed his car

My son's 16 yr. old girlfriend crashed his car into a tree while he was giving her a driving lesson. Are the girl's parents responsible for the damages? What percentage? If they do not want to pay, do I have any chances in court? The boy had no collision insurance.

Generally a parent is not responsible for the negligence of their children but if the girl has a learners permit or is a minor Fla Law requires the parent to sign assuming libility for minors negligence.It is also necessary to check if minor is a listed driver on her parents auto policy. Consult with an attorney to review these issues. They may blame your son for his negligent instructions.

Possibly. Every case depends upon all the facts

and circumstances. Whether the girlfriends' parents

can be held financially responsible depends upon

whether she was emancipated. I would also expect they

would raise the defense that your son assumed the

risk. A judge or jury would decide depending upon

all the evidence presented to them.
