Legal Question in Civil Litigation in Florida

speed humps

We live on a dead end street which has 168 households.100 private homes and 68 condo units.City followed up some neighbors complaints and put up 2 speedhumps with the threat of putting 6 more if speeding continued.I have collected signatures (one per household) and found out 100 households of 168 were against it.City manager was notified of this. But the city insisted that the majority of our street was for speed humps.City is using dirty tactics and installing them all over.We need legal help (a decent attorney) to fight the city.What would be outcome and costs and lenght of this legal procedure.Thank you for your help.

The old saying goes that "You can't fight City Hall." In today's day and age this no longer holds true but it can be very costly. Most municipalities have in house legal staffs who are very proficient in defending their government against legal action. Ultimately, you may prevail but litigation may be prolonged and will not come cheaply.

It is often to take the political route. Your attorney can ask to have the matter brought up before the commission/counsel. The residents should then lobby their representatives to see their viewpoint prior to the meeting. The meeting should be well attended by as many of your supporters who can attend. The members of the commission/council have to be elected on a regular basis and they understand the power of their vote - or the negative affect it can have when cast against the will of the people. You should seek the aid of an experienced attorney who can represent and counsel you through this process. Fees will be based on the services rendered.
