how to split property in case of divorce

my husband and i have been married for 2 years, together for7. we are about to buy a new home, he was married for 20 years, his ex-wife got the house. he is now 47 years old and his concern is that if i decide to leave he wants to be sure that he has a place to live. i have agreed that he can keep the house. my question is how would we go about making this legal, would this fall under the category of a pre-marital agreement although we are already married or should i go another way. thankyou

I am not a family law attorney, but I believe the agreement is generally known as a "post-nuptual". Seek the advice of counsel before making any agreement(s) or signing any contract(s) so you can learn what rights you may have and the various options or alternatives that you and your spouse may not have considered.
