SSDI Theft
My girlfriend recieved a check from the SSA. She could not cash it or do anything with it as she had no Identification. She was homeless and wanted to cash the check to get a home. I do not have a bank account so she was stuck. A friend said he would deposit it in his account and give her the money. They went to the bank together and deposited the check. When the time came for him to return the money , he refused to give her all of it, keeping about $1,500. This man is on SSI and has no assests. If we sue him can we claim treble damages? I know we will have to do this Pro SE because he has no assets and a judgement will probably never be paid. But since my girlfriend also is on SSDI there will be no filing fees or they will be waived. Since it is basiclly no cost to her, and this will only result in a useless judgement,am I correct in saying all it will do is effect his credit and stay on his record? But will he be liable for more than the $1,500.00?
