Legal Question in Civil Litigation in Florida

I'm in the state of Florida. So, I was hired as a chef for new restaurant and I helped them to create the menu. We don't have any written or verbal agreement that I have to give them all me recipes including the sauce. Now, I quit because my employer hasn't pay me for my 1 month work and my employer demand the sauce recipes from me stating that it's belong to the company. He never buy my recipes nor I receive any commission for those recipe for the restaurant sales. So, are my recipes belong to the company?

My employer said he will file a lawsuit against me if I don't give them my recipes due to a loss.

From the information you gave, the recipes are yours. Without a contract saying the recipes belong to the company, they really don't have a leg to stand on. Even with a contract, them not paying you would have been a breach of the contract.

Anybody can sue anybody, but you have a solid position.

Good luck.
