Can I sue my spuse in a small claims court or civil litigation for breach of contract and/or pain and suffering while we are still going through a divorce in dade county, florida.

You should ask your question to a Family law attorney (or better yet, your divorce attorney). I think all claims should be settled in the divorce proceeding.
