sued by daycare
I am being sued for $400.00 by my day care provider. She states that I broke the written contract that we had to give her a two week notice before removing my child from her care. Both My daughter's father and I gave her a three week verbal notice that our daughter was not to attend her care any longer. The initial reason that we gave her notice was that we discovered that there were times that she would leave her home and have her daughter careing for the children. I discovered her daughter has been arrested for possession of cocaine, distrubution of cocaine, assault and battery, grand theft, and a long list of other crimes. I found this out through the care provider. I proceeded to give her a notice for my daughter's termination. What can I do? Can I countersue for pain and suffering and time off work?

No, however you can defend her case. Your grounds sound ok to me. Did you have a written contract with her? If so, I suggest you read it regarding termination.
