Legal Question in Civil Litigation in Florida

Suit for rent

I moved out of me and my girl's apartment in January and have not paid any rent there because I'm not living there. She has been paying the rent since then. The lease expires in July, at which time she will have to apply by herself. Can she sue me in small claims court for half of the rent from Jan - July? Or can only the rental company sue me? Is there any claim that she can bring against me? Thank you for your help. The more descriptive and explicit your answer, the better.

Re: Suit for rent

If you are a cosignor on the lease or have otherwise obligated yourself to the lease, then your girl would proably be entitled to sue you for your proportionate share of the rental payments which you are no longer making, until she finds a replacement roomate to pay your share.

If you are a cosignor on the lease and she breaches the lease in anyway whatsoever (e.g. early termination, damage to the rental unit, etc...) then the landlord will be able to enforce the lease against you as well. Good luck
