Supoena of Records After Mistrial?

I'm planning to file a motion for a mistrial...Does one just file it with the court, or do you ask for one in person at a hearing? Also, can I supoena records from the other party after the mistrial, or must I do so before?

A mistrial happend DURING trial and the motion is almost always made orally at trial outside the presence of the jury.
