Title possession or bill of sale - who has right to ownership
Bought a boat 3 years ago. #1 person paid for it with a check out of account. #2 person claims they have a bill of sale. The title was an open title for 3 years until couple split. #1 put boat in her name, has cancelled check to prove purchase. #2 says he has bill of sale for boat, can not authenticate, for seller of boat died. Who has rights to the ownership of the boat. #2 claiming that #1 could not put title in her name for seller has since died after signing the title and it was a bad title transfer. #1 put title in her name and paid sales tax. #2 had made previous agreement with #1 to give her the title and has since retracted the verbal agreement due to #2 having financial difficulties. Please advise, no one knows the answer.

Well, I know the answer. The person who paid for the boat owns it in equity, unless the other person can prove by a preponderance of the evidence that the boat was a gift, thus the bill of sale. Want to hire me?
