Legal Question in Civil Litigation in Florida

Travel plans made, then broken

A friend and I were invited to stay at another friend's condominium in Florida for free for a week. We booked our flight reservations and then our friend who we were supposed to stay with told us we couldn't stay at the condo, but she would look for a hotel for us and stay there with us to help us with the cost (which we could not afford by ourselves because we planned to stay with her for free). Now, she refuses to even go, will not help us pay for the hotel or to cancel our tickets. The thing is, she gave us permission to saty with her before we booked our filght. Now we cannot afford to go and are out the price of our tickets. Can we take her to small claims court for the price of the tickets?

I don't think you have much of a case. Deal with the airline and try to get a credit for future travel. Many times the airline will charge a $50.00 cancellation fee, but will allow you to apply the cost of the ticket to future ticket purchases. Your friend may have legitimate excuses for not being able to let you stay at the condominium, which would serve as defenses to any legally viable claim you could have, if any.

I agree wqith Gonzalez. Dont waste your time with the courts, even if you "win", you may never collect. Try to get some concession from the airlines and take an (inexpensive) lesson from this experience. Same issues arise with "roommates, etc. Always have a plan "B".

I disagree with Mr. Gonzalez. You could file against her in small claims court, but you would have to prove you had an oral contract. This is difficult, but can be done.
