UF mental health couselor libel

My ex-boyfriend has been seeing a counselor at the University of Florida. The mental health counselor e-mailed my ex and in this e-mail was very offending advice, such as that I am emotionally unstable, emotionally dependent on men, and that he would throw a party if I ended up getting back together with my ex (I have never spoken to this counselor before). My ex then posted this on an online journal. Can I sue the University of Florida for slander/ breach of confidentiality? My reputation has been ruined due to this e-mail. I believe UF has an e-mail confidentiality rule also.

No, you cannot sue them.

The e-mail was sent to your now ex-boyfirend and was not published to others. It sounds like it was sent in the context of mental health services. It appears to express the writers opinions as opposed to factual information. The state is protected by sovereign immunity that limits your rights to recover even if you did have a valid claim.

Finally, it was your boyfriend -- not the counselor that apparently published this to the world.
