Legal Question in Civil Litigation in Florida

Unpaid loan

I loaned my ex-girlfriend $14,000, she has repaid all but $7,100 but hasn't made a payment in months. She ignores my phone messages asking to work this out amicably. Can I bring her to court to garnishee a portion of her salary?

Thanks for your help.

Re: Unpaid loan

As to the garnihsment, the answer may depend on whether she is head of household or not and what other exemptions from creditors she may have. The cause of action that you would bring would be called "Money Lent" amd this is what your complaint would look like:

COMPLAINT

Plaintiff, A. , sues defendant, B. , and alleges:

1. This is an action for damages that exceed $5,000.00 but is less than $15,000.00.

2. Defendant owes plaintiff $ .......... that is due with interest since ..... (date) ....., for money lent by plaintiff to defendant on ..... (date) ......

WHEREFORE plaintiff demands judgment for damages against defendant.

Good luck!!
