Legal Question in Civil Litigation in Florida
Vehicle Titles
My aunt paid off my car with a personal loan. Verbal agreement between us for me to pay off the loan. Did not sign, but gave her title to hold. Missed payments over summer she covered but paid her back. Missed January payment. She lives in NC and I in FL. She knew me and family would be out of town this past weekend. When we got home, Jeep was gone, thought it may have been her but she wouldn't answer phone so we reported stolen. Sheriff investigated, called her and she answered their call. Told them she was owner and had hired someone to have car towed from our yard, already had gotten NC tag for it. Sheriff said she did some things illegally (trespass, etc) but we would have to go to civil court. Called person who towed, said she gave him NC tag # and stated she was owner. Car is now in Mobile, AL. Aunt told sheriff she gave 10 day notice for me to pay loan off & I did not respond. Did not receive any such notice but she had emailed my mother that she was coming down next month to have me sign title over if I did not catch up on payment. Was car taken illegally? Was title obtained illegally without my signature? Know she has legal advice. Said at first she wanted $4000 for payoff now saying $7500. Bluebook @$9000.

Re: Vehicle Titles
I see your only claim being the value of the car that you did pay for because your aunt is not a lending institution and you don't have an agreement that would let her say you lose all of your rights in the car to date. You would need an attorney to cover all your rights in this; so think about your interest in the car and whether it is better to go after it or start over with another car.
