Veterinary Operation Misconduct

My neighbor's dog was spayed over a year ago. After the spay she developed vaginal discharge, that would appear and disappear ever so often. I was given the dog after they moved to Canada and decided to fix the problem. After 700 dollars later: urine testing, blood samples and 2 exploritory surgeries, it was discovered that the vet that performed the spay forgot to take out a uterine horn. Can I take the vet to small claims court to recoup losses due to his negligence even though the operation was performed when the animal was not mine.

I am not aware of any case exactly on point. There

are cases dealing with other professions, some of

which hold only the person receiving the services

can sue and some which hold that others can sue.

So, yes you can sue. Will you lose because you did

not own the dog at the time the services were

rendered can only be decided by the judge.
