Legal Question in Civil Litigation in Florida
I have won a Small Claims Case in Pasco County Florida because she failed to pay me rent for many months. I have not been able to collect. I was going to do a Wit of Garnishment. The person is working now and she is not married. She does have an 18 year old son in high school. She owe's me over $5,000 for rent that she never paid. She say's she makes $350 per week, but after looking at her deposits from her checking statement she had to show me, there were a lot more deposits than that. Is there any way I would be able to Garnish her wages, or is this a loss cause? Also Can I get the correct form for Pasco County Florida for Wit of Garnishment if I should proceed?
Thank You,
Brett

Yes, you can attempt to do that. If she has a bank account, why not garnish the account? Are there funds in it? More on a given date then others? You should review this with an attorney to make sure you approach it appropriately. The Clerk's office should be able to give you the form. It is in the rules of civil procedure.
