Legal Question in Health Care Law in Florida

My question is I work for a hospital that now when someone has been screened by a dr in the er that if they dont have insurance that they can pay 200.00 if its not really urgent example toothache, if you do have insurnace they want your copay say 75.00 if you dont have it they said we are to tell the patient they cant be seen after being screened by the dr is all this legal??
