Legal Question in Health Care Law in Florida

Guardianship Change

40 y.o. male has stroke and ends up in nursing home with stepmom as guardian of his medicare check. I assume this decision was made when he was unable to make a decision due to his medical condition. He has body damage to left side but his mind is okay. How can he get control of his medicare check and get his stepmom removed as his guardian?

Re: Guardianship Change

Absent a valid reason to believe that the guardian is acting in any way improperly -- facts not revealed in your question -- then you probably can't get the guardian removed.
