Legal Question in Health Care Law in Florida
HIPPA Violation?
I sent out emails and postcards to my patients telling them I was at a new location. The former location is saying this is a HIPPA violation, patient harrassment, and I have their data base. They plan legal action. Do they have a case? thank you.

If you took a mailing list or patient list from the office, that is not a HIPPA issue, but it probably is something that they can sue you for as stealing proprietary information from the business. Itwas their (the business's) patient list, not yours. Now, if you simply were able to recall your patients' names then that is OK, but if you stole the list and used it, then that is probably a "no no".
