Legal Question in Health Care Law in Florida

involuntary hold-mental health

my father is convinced that i am using illegal drugs on a daily basis. As an addict in and out of recovery, I am currently investigating voluntary re-hab w/my church counselor, but continue to receive threat calls from 'dad'- aside from the fact that he is incorrect. ( though unfortunately i have the occasional relapse). is he correct that he can have me subpeonad, brought to jail until judge makes decision? 'dad' is a convicted felon (any credibility?) with no proof (as his belief is incorrect) to show re any current drug use or health issues.

Re: involuntary hold-mental health

The Baker Act has some very strict requirements. That someone is using drugs -- even if true -- woiuld not permit you to be involuntarily held. A call to the police might prompt a search of your residence or car. If anything was found, of course, you might be arrested.
