mary a citizen of florida was walking one day when a large crate flew off a truck and hit her, she suis for medical expenses. the firm headquarters are in georgia although the compant does business in florida. in what court might she bring a suit. florida state court, georgia state court or federal court. what factors will influence her decisions

she could sue in Florida where she lives and where the accident happenned or in georgia where the company is located. No real reason to sue up there. Sue in Florida where she is located. Most all the witnesses are here in florida so it will be less expensive to prosecute.

State court is almost always preferred, but the georgioa company will have the right almost certainly to drag you to federal court -- unless the driver was a FL citizen that you can sue along with the compeny. Plenty of smaller considerations, but that is the big picture. An attorney can easily explain the small stuff -- but you'll almost certainly be in Florida State court.
