Legal Question in Health Care Law in Florida
Withholding payrole checks
My employer is telling me that without my CEU of HIV update documentation of the class I've taken, that I will not be able to pick up my check this week. I do not owe the company any money and I've already worked for this check. So my question is does this company has right to keep my check or checks until I bring them the certificate of HIV which I will not be able to get a copy of for atleast three weeks? Please answer ASAP Thank-You.

Re: Withholding payrole checks
Quick answer: No
You already earned that money. They have no legal justification for refusing to pay.
If they continue to refuse to pay, then seek a formal consultation with an attorney. In such cases, if you win, the court will likely hold the employer responsible for your attorney fees and costs.
You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee. If you are located within the Greater Tampa/St. Petersburg area, I would be happy to meet with you
