130 petition for my son was denied , i file eoir 29 to appeal the uscis officer told me that i have to await bia descision which will take one year to four years wait , can i do anything else or can i refile the case my son is 19 and he can't go to school or work in the us , yes he has his ged but he is stock waiting on the bia and the uscis said i have to wait before i could do any thing ..... what can i do please help i sent 5000.00 dollars already

It is rare that an I-130 petition is denied, & I am unsure to whom you paid $5,000.
You could theoretically re-file the I-130 petition (depending on why it was denied in the first place), however, if your son is in the United States without authorization, then he is not going to be able to adjust status anyway.
