adult adoption for immigration purposes

I am interested in adopting a

Brazilian who is living in the US as a

tourist and would like to remain

here. Is it possible for a US citizen

to adopt an adult from Brazilian and

the Brazilian live with me legally?

We are a gay couple so marriage is

not an option for us for immigration

purposes.

No, adoption unfortunately cannot be done. This is because for an adoption to be successful for immigration purposes the person must be under 16 years old at the time of the adoption. More so, the adoptive parent must have had had custody and resided with the person for 2 years.

However, there may be other options available to you partner. But in order to take advantage of them he must not remain in the U.S. past his authorized period of stay. Employment visas are available now, depending on his education and experience.

No. Generally, an adoption must be finalized before the child reaches the age of 16 to be valid for immigration purposes.
