Affidavit of Support

Hi, I petitioned my father for US legal residence in 2006. He has become ill and is currently at a local community hospital.

If he is unable to pay, Am I liable for his medical bills under the Affidavit of Support that I signed for his petition?

He is being asked to fill out Medicaid application. Would I be held liable for that? Should I tell him not to apply for Medicaid and try to negotiate his hospital bill with the hospital directly?

Please advice.

Dear Inquirer:

You may be liable for your father's use of any public "means tested benefits," which can include medical treatment aside from emergency medical care. You may want to review the I-864 document you signed and consult with an immigration specialist regarding your father's situation before you advise him to apply for Medicaid.
