Apply for Visa while in probation

I was convicted of a felony

(structuring transactions) for which I

received 5 years probation. We

believe it is not a CIMT.

I plan to travel to mexico to get a

new visa mainly to force an

immigration resolution for my case.

My lawyer says that being on

probation is not an impediment for

me getting the visa but I am afraid

the it will make things even more

difficult.

Please advise.

You need to be 100% clear that your conviction does not render you inadmissible before departing the US. If you are indamissible, the only resolution you will obtain is a denial of your new visa application.
