Legal Question in Immigration Law in Florida

Back in 1998, my ex paid someone to help him get legal. This person must have had a connection at INS who falsified documents. On these documents he appears married to some woman he never met. Needless to say, he never got legal. A few years ago, he went to an attorney with the false documents to check if he was anywhere in the INS system. The attorney wasn�t able to find him as married anywhere. Recently he paid someone to marry him for papers and on Oct. of 2010, they got married at the courthouse. Last week, he and his �wife� went to their first interview. Once there and after some questions, the he soon found out that INS new all about the false documents and that he has deportation since 2009. So today he received a letter in the mail informing him that he has 30 days to depart this country.

Does he have any chance of appealing and remaining in the United States at this point? We have 2 kids together.
