Legal Question in Immigration Law in Florida

I am a US citizen. My filipina fianc� has just been granted permanent residency status in Canada. (She has been working in the Edmonton, AB area for over three years as a caregiver.) She will now be living and working in Toronto.

Question 1: Can she visit me is the US? If so, for how long a period of time?

Question 2: When I apply for the K1 Visa for us to be married in the US, will it be for her as a Canadian (using her Toronto address) or as a Philippine citizen? Would the process be faster and easier were she considered under her Canadian status rather than under her Philippine status?

Bruce,

Yes your wife can visit you. However once she is granted the K1 visa, the two of you must marry within 3 months or she will have to leave the US. As an alternative, you can marry her in Canada and bring her here on a K3 visa or do Consular Processing. You should know that since your fiance is only a Canadian resident and still a citizen of the Phillipines the processing will more than likely have to go through both places. Your fiancee is a Canadian Resident but a national of the Philippines. Her consular processing though can be done in Canada as she resides there.
