I am us citizen and I want to marry my boyfriend who is illegal. I was in jail for drugs and have court on april 26 th. I am on one year probation. If I will be charged for felony can I still marry my boyfriend and file papers for his status adjustment?

Yes, you can marry your boyfriend but the process in which your boyfriend can get a green card will vary depending on the facts of your case. Your boyfriend may adjust status while in the United States if he is 245i eligible. To be a 245i eligible, an immigrant petition must have been filed on his behalf before April 30, 2001. If he is not 245i eligible, he must file for his green card at a U.S. Consulate abroad with a waiver. The waiver will have to demonstrate that you will suffer extreme hardship if he is not allowed to return to the U.S. These cases are very fact-specific and require the assistance of an immigration attorney.
