Legal Question in Immigration Law in Florida

Hello I've been arrested last year and my case as of today is closed . It is my first time and I was not offered the PTI program (in Fl.)however i accepted what the state offered :with holding adjudication, no probation(not all charges were dropped). This is for a couple of felonies. At the time of the arrest I had compleated more than 5 years in US with green card. I pleaded no contest. Now I am concered about deportation having this on my record. I would like to study abroad ,I might have problems coming back in the US? How far citizenship in my case?

Your query poses many questions.

First of all, what were you convicted of? Drug offenses for example are treated much differently than weapons possession or domestic violence. (See my previous replies regarding the differences between a Crime of Moral Turpitude ("CIMT") and an Aggravated Felony, and Mandatory Detention versus the ability to get a bond).

Also did you receive a Notice to Appear ("NTA")? What were the charges on that document?

It is important to evaluate many issues relating to your underlying criminal charges as well as the charges brought against you by the Immigration Service and DHS - and there is often a possibility that there was a great miscommunication between the state criminal court where you received your criminal charges and how they translate federally in the context of Deportation and Removal.

A definite answer can not be given without actually seeing the criminal court records. However, in all likelihood you probably rendered yourself subject to removal proceedings. Although it would have been far better to consult an Immigration attorney before entering the plea it could still be possible to resolve this problem.

I would suggest that you get a copy of your arrest record and court disposition and then make an appointment with an Immigration attorney in your geographical area to review your case.
