Due Process Clause
I am doing a term paper on how due process relates to Haitians as opposed to others who try and make it to Fl. soil. My question is: How does the due process clause apply to the situation with the latest Haitian ''boat people'' in Miami.

Good Question. Try reading SALE v INS by the Supreme Court. However, the jist is: Due Process is due to only those physically present in the US. Also, look at Knauf v Shehnessy (sp?) where the Supreme Court held that due process for immigration purposes is whatever Congress says it is. Email any other questions direct.
