E2 Visa Renewal

My husband is out of the country applying for a renewal of his E.2 visa - the embassy wants information from him for a 1981 arrest. I find nothing on it because the records were expunged - how can I prove to State Dept the records were expunged?

The issue is not proving that the record was expunged. The issue is what the conviction was for and will it make your husband inadmissable to the US in spite of the expungement? If it was for drugs, he many be out of luck since a drug conviction usually cannot be expunged for immigration purposes. In addition, if he lied about his record when he applied for a visa initially, he could have an additional ground of inadmissabilty.

I suggest you hire a criminal lawyer in Flordia to try to obtain the conviction and then hire an immigration lawyer (if you don't already have one) to try to get your husband back to the US.
