F1 to H4 status conversion
Iam studying on F1 visa. Due to some family circumstances I want to fall back on H4 visa. Is it easy to get a conversion from F1 to H4.Will INS ask reasons or do we have to provide proof of the reason we give for INS to approve the case.I dont want to disclose my family problems to INS.What am I supposed to do to get converted back to H4 status.Please consider my case, it is very important that I know.Thank You.

Technically, as long as you have a qualifying relationship with the H-1B holder, you can qualify for the H-4. You might still provide a brief explanation for the change, such as no money for tuition, etc.

There shouldn't be a problem. Nevertheless you will have to establish certain requirements (i.e. marrige to an H-1, make sure the H-1 has not fallen out of status, etc.) so that the change of status goes through smoothly. If you have concerns about this you may contact our office at (732) 985-1310.

Changing status from an F-1 student to an H-4 dependent spousal status is not a problem as long as you are still married to the H-1 holder, the status is currently valid and there are no lapses in status for the H-1 holder.
