Legal Question in Immigration Law in Florida

fiance visa

I want to marry someone who is in another country. I have not married this person in the other country. I dont want to marry this person in his country I only want to get married here. Can I still apply for a fiance visa? Also I have a record it is not one that will bar me from sponsoring him I checked it out. My main concern is he does not know about my criminal record and I know they ask in interview and on application but at any time during the immigration process will my fiance find out about my record. The main thing for me is that he does not find out about my record. Also if he does get back to usa some other way like tourist visa and then I want to marry him while he is in usa will immigration still want to know about my criminal history.

Re: fiance visa

My question to you is do you love this guy? If you have a criminal record, it depends on what it is before you can be certain your fiance will be denied a visa. Second, if he enters the U.S. on a tourist visa, it may be harmful to marry because then the government could claim he had intentions to remain in the U.S. -- a tourist visa requires that the applicant not have any intention to remain in the U.S. I suggest you seek counsel and find out whether your criminal record is that serious that it would preclude a fiance visa.

Wish you the best of luck.
