Legal Question in Immigration Law in Florida
I am filing out a I-130 form to petition my brother. I have just noticed that our mothers name is inaccurate on both our birth certificates and do not match although we have the same mother. We were both born in Tanzania and it would be virtually impossible to have this corrected. What should i do?

You will need to write a thorough explaination to USCIS detailing the problem and why the certificates are incorrect. You will then also need to get sworn affidavits from people who have known both of you to attest to the fact that you are brother and sister and that you share the same mother. If your mother is still alive, she can also prepare a sworn affidavit stating this as well. Also, if you have any other official documents that show that you and your sister have the same mother with the proper name of your mother then that would be helpful as well. Be prepared for USCIS to question this situation. You may also want to get a certified letter from the Tanzania government that there was an error or otherwise have the agency correct the problem before submitting your application to USCIS.
