Legal Question in Immigration Law in Florida
Green Card
I have a friend who came to the U.S on a visa, but met someone and fell in love so he decided to stay (he overstayed on his visa). He was so in love with this girl that a few months later they got married. After being married for four years, they decided to apply for his green card, but midway through the process his wife started acting weird. She probably cheating came to his mind, but he washed it out because knowing how they fell in love so fast, he never thought that she would ever do a thing like that. The day for his interview came and he was denied. what are his options? are there any hope for him at this time? If he investigates and finds out that she has been cheating and he gets a divorce, is he able to remarry in the future and reapply? I'm concerned for my friend and I feel like his wife he thought that truly loved him messed up.

Re: Green Card
Yes, he can divorce and remarry a U.S. citizen. He can also re-apply for his permanent residence once married to another U.S. citizen. However, he won't have any legal status in the country until he files for his adjustment of status through the new spouse.
