H 1 visa cap

I have a buisness and want to know if I can bring a java developer here from india but first I want to know if the h 1 visa cap has been decided for 2010 or 2011 if so how many will the lottery alow for someone in india with a bachelors degree?

No, the H-1B Cap for the 2010 Fiscal Year (which begins on October 1, 2009) or for FY 2011 has not been fulfilled yet. This is because on April 1 of each year H-1B filings are accepted. In recent recent years, a random selection process (akin to a lottery) has been used for the petitions submitted within the first 5 days of filing.

Depending on the person's qualifications, there are roughly 60,000 visas each year and an additional 20,000 visas each year for persons who earned master's degrees in their related occupation from a U.S. university. As well, there are exempt employees, such as for those who previously had H-1B status over the past six years, or for other institutions.

Due to the current economic situation, H-1B filings may be down as compared to other years. However, we won't know how many applicants are in the "lottery" this year until after the window of filing closes.
