Legal Question in Immigration Law in Florida

Hello,

I have been living in US for over 10 years. I overstayed my visa. I have a 1 year old child. In May I married an American citizen. But.. a few days after the wedding he was arrested for drugs. I didn't know about his problem. Since then we are not in touch. Is there any way I can get a green card? Thank you for your reply

Hello:

That depends if he still is married to you, loves you and wants to petition for you. Even if he is in jail, he can do this. Otherwise, if he abused you, you can file for the VAWA.
