Immigrant with valid visa but with expired I-94

Immigrant arrived to the U.S in 1996 with valid visa as well as a valid I-94 (The I-94 is the document stampted depicting the date at which the immigrant must return). The date on said I-94 has expired and the immigrant has not left the U.S

Given the above mentioned scenario, if said immigrant is leagally and genuinely married in the U.S. in the current year(1999), and married to an authentic U.S citizen, what are the proper and leagal procedures for said immigrant to be recorgnized as a leagal perminent U.S. resident given any and all current immigration laws pertaining to same.

More information needed. What was the date that the I-94 expired? Waivers of the 3 and 10 years bars are available for spouses of US citizens.
