Legal Question in Immigration Law in Florida

immigration and child support

My son's father was illegal,from Australia,when we had a son together 3 yrs.ago.He's been a sporadic presence in our lives,but was ordered to pay $302/mth.in child support.He has our son every weekend although no visitation has been determined through the courts.He's now suing me for partial custody,and I,in turn,am suing for more child support. Although he denies it,I have determined that he was married to an American citizen in May, 2003.But,he could'nt produce any proof of income when filling out his financial affidavit,claiming he's self employed,(he is not paying any taxes.)When we were together,I researched the process of marriage and the documentation needed.If memory serves me,I recall needing proof of same residence,and maintaining a joint bank account for INS.I believe he's denying the marriage in order to hide his income.How can I prove his income(which I personally know is more than 3 times what he is claiming),and can you please inform me on the requirements of proving an unfraudulent marriage(if he is, in fact,required to maintain a joint bank account.)My lawyer is very good,but is unfamiliar with immigration law, so I'm doing what I can to keep the costs down, and do my own research.

Unfortunately, you are going to have to hire an immigration attorney. You can do a FOIA request for the files and proving an unfraudulent marriage should be known by all attorneys. What county is this prcoeeding in? Email more questions to [email protected]
