can someone who comes here on an h 1 visa who's green card has not started bring his wife or kids over to the usa?

I take it that you mean you (or someone you know) will be coming to the U.S. in H-1B status, and has not filed for permanent residence. Spouses and children under the age of 21 are allowed to travel with the principal H-1B holder. They will need to apply at the consulate with him for their visas, called H-4s. They will be allowed to stay here for the amount of time that the husband is granted.
