Legal Question in Immigration Law in Florida

Immigration through my mother (Citizen)

My mother got her citizenship two weeks ago and would like to file a petition for us (Me 25, my Husband 30 and our daughter 5). We have another daughter (3) but she was born here and is a citizen.

My question is: We came with a tourist visa to visit them (current) and would like to know if there is any way to stay here until the papers come out.

We are looking for a good immigration attorney to handle our case. Can we stay here with some kind of temporary permit until our residence is granted?, or do we have to go back to Ecuador and stay there until it is emitted?.

I know it's a few years, but how many years does it take for the results to come out?.

Thank you for your question.

Unfortunately, the waiting list for residence in your category (Married daughter of US Citizen) is currently backlogged to June of 2000 so you are looking at a wait of approximately 8 years or more.

The only way that you would be able to remain in the US for any great length of time would be if you or your husband are eligible for some sort of non-immigrant employment based visa such as an E, H, or L. You are right in wanting to consult with an Immigration attorney regarding all these issues. I would be happy to speak with you, however whoever you consult with please be sure to ask about their experience with Immigration law and also confirm that they are a member of the American Immigration Lawyers Association.
