Immigration warrant arrest

My husband has an immigration hold to be deported to Honduras. I am an american citizen. He is now serving 28 day in jail for driving with no valid DL. I am in the process of petition him. He was suppost to appear in front of an immigration judge last year and he fail to go. If I submit the petition will they still take deport him out of the US. I there any special procedure I can do to stop the deportation. I am in a medical leave and if they take him it will cause me a financial hardship.

There are procedures to stop deportation in cases such as this. However it involves a motion before the Court and you will need to retain an attorney to see if your husband qualifies for such a motion and for that attorney to file and litigate the motion.
