k1 bride, conditional resident, wants a legal separation
I was a bride with the K-1 visa, got married 2 months after I moved to USA. I am a conditional permanent resident, I have my green card since march 2004 without interview. I was living in a shelter for 2 months in 2003 for Domestic Violence (verbally, economical abuse), he never hit me. I returned with my husband and lived a suppossed ''normal'' way. The verbally abuse is running again. I never had worked in USA, my husband is very insecure; his ex-wife had the same problem with him, and she was living in the same shelter than me for 3 times (the last time for physical abuse). I need to help him in all the ways, but he never can feel happy with my help, and yelled me for everything, after that he started to cry and say ''sorry, was the stress'', I don't have any evidence for mental abuse, call to the police or another big thing to proof my fears about my husband. I don't have money, or credit history; don't have access to my mail, just the shelter and the therapist records when I was living there; I had a surgery less than week, and he is still pushing me to clean his houses and do something for him, he call that ''my responsability'', I don't want to live in this way, being scare all the time, I love him buy he make feel unhappy.

You still seem to qualify for battered spouse even though you never were physically hit. This process is long and usually does nto allow work authorization for many months. You can call or email me:

You still may be eligible for a domestic violence waiver based on the abuse. The abuse does not have to be physical in nature to constitute abuse but it is harder to prove without a police report or witnesses to the abuse.
