Legal Question in Immigration Law in Florida
I like to K-1 petition my fiancee. We have a 6-month relationship, have met in person, and both are free to marry. A year ago, my fiancee had an issue with her B1-B2 tourist visa. During an interview with the Consul to petition for her son's tourist visa, her visa was cancelled when the Consul felt she had stayed working in the US during her last visit of 7 weeks. My fiancee explained to the Consul she did not work but Consul felt differently and her visa was cancelled on the spot. Are we going to encounter any issues with the K-1 petition and (or) the Spouse K-3 visa be a wiser route? By her visa being cancelled, is she forbidden from entering the US in the future?
